Hosting - Policy & Disclaimer
Internet Marketing Specialists, Inc. ( hereinafter known as IMS) provides quality web hosting to many clients, and we have a responsibility to provide each client with the best possible service. The following guidelines have been established to insure this goal is met.
COMPLAINTS
If you receive spam from one of our customers or believe the web site of one of our customers violates this policy, please email abuse@developersdesk.com.
We will review the email, pending our investigation act accordingly.
HOSTING POLICY
IMS will be the sole arbiter as to what constitutes a violation of these provisions.
We will immediately disable the account of any IMS member conducting illegal activities, without warning. SPAM, while not illegal is a unacceptable practice that will not be tolerated on IMS servers.
IMS will cooperate with other Internet Service Providers and law enforcement agencies investigating illegal and improper activities.
If you want to add material to your site that you are unsure about, or have any other questions on the on this policy, please email us at ims@developersdesk.com for an evaluation.
There are no refunds on accounts terminated for cause.
Prohibited Content:
All services provided by IMS must be used for lawful purposes only.
Transmission, storage, or presentation of any information, data or material in violation of any International Laws and/or Treaties, United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material that is not eligible for export from the United States, material we judge to be harassing, threatening or obscene, or material protected by trade secrets and other statutes.
Pornography and sex-related merchandising are prohibited, including sites that may infer sexual content.
Also prohibited are sites that promote illegal activity or content that may be damaging to IMS servers or any other server on the Internet. This also includes, but not limited to pirated software, hacker programs/archives, and Warez sites.
Links to the above materials are also prohibited.
Prohibited Activities:
SPAM:
Spamming, the sending of unsolicited email, is STRICTLY prohibited. We take spamming very seriously and will immediately disable, without warning, the account of any IMS customer sending SPAM.
We do not watch your outgoing email, but if we get complaints that we consider spam your account will be terminated. If you have any doubts about your email policy, please ask BEFORE you send.
Hacking:
Any attempt by an IMS customer to hack, break into, or otherwise obtain unauthorized access to any computer on the Internet, will result in termination of your account. This applies even if no IMS machines were used in the attack.
Chat Rooms and IRC:
No IRC servers. We are in the business of providing the best web services available. The high bandwidth utilization of an IRC server could interfere with the quality of our web services.
We do not allow our customers to install their own chat rooms.
Furthermore, we DO NOT allow IRC or IRC bots to be operated on our servers. You are free to link to other servers that provide these services, as long as, they do not run on our site.
Background programs:
IMS does NOT allow customer installed daeomons or programs that run continually in the background. For some services we provide programs that are run on a schedule, web site accounting for example. (Using cron.) We may setup your program to run on a schedule, at our discretion. In general, you should avoid this feature when you design your project, unless you can demonstrate how scheduling the process will reduce our server load. If we decide to schedule your program, you must provide us with the source code of the program for us to inspect, compile and install. You will not be able to update the program. This installation is billable at our normal hourly rate. If you want to schedule a program that can be downloaded from the Internet, just send us it's location, we will download it.
Bandwidth Usage
Your basic hosting fees provide 500MB/month with an additional $5.00 for each additional 25MB transferred. You can monitor your bandwidth useage on the statistics web page for your domain.
Invoicing & Refunds:
Your first hosting bill will include setup fees, the pro-rated first month plus the second month in advance. Each bill thereafter will include the following months connectivity along with excess bandwidth, disk space, and email addresses for the preceding month.
Payments are due on the 10th of each month, unless other arrangements have been made in advance. Only a physical letter (snail mail) from us can authorize a different due date. There is a $5.00 finance charge for late payments.
We do not give refunds if you choose to terminate your account before the end of the month. As long as your account is current and you are not in violation of this policy, you are entitled to keep your services active on our machines until the end of the final month. (This may help you move your site to another host if you so desire. We will work with your new provider to attempt a seamless transfer.)

Ownership
When we create a web site for you, you own the layout, all the static
pages and images. Many of the programs we use to to create dynamic
content on your web site are Open Source. We don't own then, and
neither do you. In general they follow the GNU Copyleft, but if you are worried, you need to check on each one
individually.
What we charge you for is selecting, downloading, installing and
updating the program to match the look and feel of your web site. We
are not charging you for the program. We must follow the license
agreement of the program. We guarantee that the installation on our
server is a legal use of the program.
No guarantee on other servers
Our servers are unique. Although they use commonly available Open
Source software they are setup in a way we selected for our convenience
in setting up web sites. This setup may not work on someone else's
servers. We do not make any warranty that programs that operate on our
servers will work anywhere else.
If you want us to move a program from our server to another service, the
work will be done on a time and materials basis. If you have someone
else do the work we will provide a copy of the code that works on our
servers at no charge, if we are allowed to by the license of that
software. If we cannot provide the source code we will provide the
location where it can be downloaded from. There may be a licensing fee
to use that software at the other location, we are not responsible for
that fee. We reserve the right to charge for consulting time if that
other programmer has questions or needs help.
Importance of communications
We are a web based business, and you are adding your business to the
Internet. The most common way to communicate on the Internet is email.
When we accept your contract we will ask you to provide us with an email
address of your choice. This address may be on our servers, or any
other mail server of your choice. Unless other arrangements are made we
will direct most of our communications thru that email address. We
expect you to monitor the email address you have selected, and respond
in a timely manner.
Timely response to requests for information
Since we limit the number of concurrent clients, and make half our money
of the completion of web sites, we reserve the right to move another
project in front our yours if you are unable to provide us with needed
information in a timely manner. Due to the effort involved in changing
projects, if we start something else while we are waiting for content
from you we will finish that project before we resume yours. We will
make every attempt to schedule your project so that we make our requests
for information as early as possible, and have things to do while you
compile the needed information, but we cannot afford to sit idle if it
takes days or weeks for you to provide content.
DISCLAIMER
IMS does not control the content of pages hosted on our servers and may not even look at them. Therefore we accept no responsibility for any claims resulting from their contents. If you have a problem with an IMS customer and you think we should do something about it, email us at abuse@developersdesk.com. If we find the content illegal or offensive we will disable the site.
IMS cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by IMS Inc. are resold. Thus, certain equipment, routing, software, and programming used by IMS Inc. are not directly owned or written by IMS. Moreover, IMS Inc. holds no responsibility for the use of our clients' accounts. If any terms or conditions are not followed, the account in question will be suspended or terminated. IMS, reserves the right to remove any account without advance notice for any reason.
PRIVACY
We do not provide any information about our customers that is not disclosed on their web pages without a valid search warrant or court order.
